Marcel’s experience has focused on the litigation of
civil rights, employment, and commercial cases and
the defense of the criminally accused. Specifically,
he has spent years advocating on behalf of his
clients’ constitutional and civil rights, primarily
in federal court, in cases involving police
misconduct, first amendment free-speech issues, and
race, gender, national origin, and age
discrimination. Marcel has successfully represented
clients at all stages of litigation in both federal
and state court, has litigated approximately a dozen
jury trials and many more trials to the court. In
addition, Marcel has argued criminal appeals before
the Colorado Court of Appeals and a difficult civil
rights case before the federal Tenth Circuit Court
of Appeals. While trial experience is critical to a
litigator, having the judgment to know when to
settle is indispensible. Marcel understands that a
client does not necessarily benefit from a judgment
in his or her favor; a trial can only be considered
a “win” if the verdict places the client in a better
position than he or she would have been had the
opposition’s best settlement offer been accepted.
Consequently, he works diligently to understand the
facts, law, venue, and nuances of each case in an
effort to determine which cases should be settled
and which should be brought to trial.
More recently, Marcel has focused on business and
contractual disputes, including breach of contract
claims, forcible entry and detainer (eviction)
actions, and the preparation and negotiation of
commercial leases.
